Welcome to ParMitra.

These Terms and Conditions ("Terms") govern your access to and use of the ParMitra mobile application, website, and related services (collectively, the "Services").

By creating an account or using ParMitra, you agree to be bound by these Terms. If you do not agree with these Terms, you must not use the Services.

2. About ParMitra

ParMitra is a community platform designed to connect Nepalis around the world.

The Services may include, but are not limited to:

• Job listings
• Room and accommodation listings
• Business directory listings
• Community events
• Messaging between users
• Community networking
• Other services introduced by ParMitra from time to time

ParMitra provides a platform for users to connect and share information. Unless expressly stated, ParMitra is not:

• an employer
• a recruitment agency
• a real estate agency
• a property manager
• an event organiser
• a travel agency
• a party to agreements entered into between users

Users are solely responsible for the decisions they make and the transactions they enter into through the Services.

3. Eligibility

You may use ParMitra only if:

• you are at least 13 years old, or the minimum age required by the laws of your country, whichever is higher
• you have the legal capacity to enter into a binding agreement, and
• you comply with these Terms and all applicable laws

You must not create an account on behalf of another person without their permission.

4. Your Account

To use certain features, you must create an account.

You agree to:

• provide accurate and complete information
• keep your account information up to date
• maintain the confidentiality of your password
• notify us promptly if you believe your account has been accessed without your permission, and
• accept responsibility for all activity that occurs under your account

You are responsible for safeguarding your login credentials.

5. Your Responsibilities

You agree to use ParMitra responsibly and lawfully.

You must not:

• provide false or misleading information
• impersonate another individual or organisation
• use stolen photographs or documents
• create fake accounts
• interfere with the operation or security of the Services
• attempt to gain unauthorised access to any part of the platform
• distribute malware or harmful software
• use automated tools to scrape or collect data from ParMitra without our written permission, or
• engage in any activity that violates applicable law

6. User Content

You retain ownership of the content you create and publish through ParMitra.

This includes:

• listings
• photographs
• descriptions
• messages
• profile information, and
• other content you submit

By submitting content, you grant ParMitra a non-exclusive, worldwide, royalty-free licence to host, store, display, reproduce, and distribute that content solely for the purpose of operating, improving, promoting, and providing the Services.

You represent that you have the necessary rights and permissions to publish any content you submit.

7. Community Standards

Users are expected to interact respectfully.

You must not post or share content that:

• is unlawful
• is fraudulent or misleading
• promotes violence or hatred
• harasses or threatens another person
• contains sexually explicit material
• promotes illegal goods or services
• infringes another person's intellectual property rights
• contains malicious software, or
• is otherwise inappropriate for a community platform

ParMitra may remove content that violates these Terms or applicable law.

8. Messaging

ParMitra allows users to communicate through private messaging.

Users are responsible for the content of their messages.

You must not use messaging to:

• send spam
• harass others
• distribute illegal content
• impersonate another person
• conduct fraudulent activity, or
• violate these Terms

ParMitra may take action where messaging is used in breach of these Terms or applicable law.

9. Temporary Media

ParMitra provides privacy-focused options for sharing images and certain supported documents.

Depending on the sharing option selected by the sender, media may:

• expire after viewing
• expire after a limited period
• be automatically removed from conversations, and
• be permanently deleted from ParMitra's servers after the applicable retention period

Users acknowledge that while ParMitra implements technical measures to protect shared media, recipients may still capture or reproduce content using external devices or other methods beyond our control.

10. Accuracy of Listings

Users are solely responsible for the accuracy of the information they publish.

ParMitra does not verify every listing and does not guarantee that any listing is complete, accurate, current, or genuine.

Users should exercise reasonable caution before entering into any agreement or transaction with another user.

11. Fees and Future Paid Services

Most features of ParMitra may be available free of charge. ParMitra may introduce optional paid services in the future, including but not limited to:

• premium memberships
• promoted listings
• advertising services
• verification services, and
• other paid features

Any applicable fees, billing terms, cancellation rights, and refund policies will be clearly communicated before payment is required.

12. Job Listings

ParMitra provides a platform where employers and job seekers can connect.

Employers are solely responsible for ensuring that job advertisements are accurate, lawful, and not misleading.

Job listings should include truthful information about, where applicable:

• Job title
• Job responsibilities
• Location
• Salary or salary range (where disclosed)
• Employment type
• Required qualifications
• Application process

Employers must not:

• Advertise fake or misleading jobs
• Charge unlawful recruitment or placement fees
• Request sensitive personal or financial information unless reasonably necessary for the recruitment process
• Discriminate unlawfully against applicants

Job seekers are responsible for ensuring that the information they provide is accurate and truthful. ParMitra does not guarantee employment opportunities, interview invitations, job offers, or the conduct of employers or applicants.

13. Room & Accommodation Listings

ParMitra enables users to advertise and discover accommodation.

Users publishing accommodation listings are responsible for ensuring that:

• They have the legal authority to advertise the property
• Listing descriptions are accurate
• Photos accurately represent the accommodation
• Pricing is truthful
• Availability information is kept reasonably up to date

ParMitra does not:

• Inspect properties
• Verify ownership of every listing
• Guarantee the condition, safety, legality, or availability of any accommodation

Users should independently verify accommodation before making payments or entering into rental agreements.

14. Business Listings

Businesses listed on ParMitra are created and managed by the business owner or authorised representative.

Businesses are responsible for ensuring that:

• Information is accurate
• Contact details are correct
• Photos fairly represent the business
• Products and services comply with applicable laws

ParMitra does not endorse or guarantee any business, product, or service listed on the platform unless expressly stated. Users are responsible for making their own decisions before purchasing products or services.

15. Events

ParMitra allows users and organisations to publish community events.

Event organisers are responsible for:

• Event accuracy
• Venue information
• Dates and times
• Ticket pricing
• Event safety
• Compliance with applicable laws

Unless expressly stated, ParMitra is not the organiser of events published on the platform. ParMitra is not responsible for event cancellations, schedule changes, venue changes, refunds, or disputes between organisers and attendees.

16. Reviews and Ratings (For Future Use)

ParMitra may introduce reviews, ratings, recommendations, or feedback features in the future.

Where available, users agree to provide honest and respectful feedback.

Fake reviews, manipulated ratings, or attempts to unfairly influence another user's reputation may result in content removal or account action.

17. Intellectual Property

All intellectual property relating to ParMitra, including but not limited to the ParMitra name, logos, branding, app design, user interface, graphics, icons, software, source code, databases, and original content created by ParMitra, remains the property of ParMitra or its licensors unless otherwise stated.

Users may not:

• Copy
• Modify
• Reverse engineer
• Redistribute
• Sell
• Commercially exploit

any part of the Services without our prior written permission.

18. Copyright Infringement

Users must not upload content that infringes another person's copyright, trademark, or other intellectual property rights.

If you believe that content published on ParMitra infringes your intellectual property rights, you may contact us with sufficient information to investigate the matter.

ParMitra reserves the right to remove allegedly infringing content while investigating complaints.

19. Prohibited Activities

Users must not use ParMitra to:

• Commit fraud
• Scam or deceive others
• Publish fake listings
• Sell illegal goods
• Promote violence
• Encourage hatred or discrimination
• Harass, threaten, or intimidate others
• Share another person's private information without permission
• Upload malicious software
• Circumvent platform security
• Attempt to gain unauthorised access to ParMitra systems
• Use bots or automated tools without permission
• Interfere with other users' enjoyment of the Services

Serious or repeated violations may result in suspension or permanent removal of your account.

20. Suspension and Termination

ParMitra may suspend, restrict, or terminate accounts where we reasonably believe that a user has:

• Violated these Terms
• Violated applicable laws
• Engaged in fraudulent activity
• Created significant risk to other users
• Attempted to compromise the security or integrity of the platform

Where appropriate, we may provide notice before taking action. However, we may suspend or terminate access immediately where necessary to protect users, comply with legal obligations, or maintain platform security.

21. Disclaimer

ParMitra is a technology platform that connects members of the community. We do not guarantee:

• That users will obtain employment
• That accommodation listings are accurate or available
• That businesses will meet user expectations
• That events will proceed as advertised
• That communications between users will result in successful transactions

Users interact with one another at their own discretion and risk.

22. Limitation of Liability

To the fullest extent permitted by applicable law, ParMitra and its owners, employees, contractors, and affiliates are not liable for:

• Losses arising from user-generated content
• Disputes between users
• Financial loss resulting from transactions between users
• Damage arising from inaccurate listings
• Temporary interruptions or unavailability of the Services
• Loss of data beyond our reasonable control
• Indirect, incidental, special, or consequential damages

Nothing in these Terms excludes liability that cannot lawfully be excluded.

23. Indemnity

You agree to indemnify and hold harmless ParMitra, its owners, employees, contractors, and affiliates from any claims, damages, losses, liabilities, costs, or expenses arising from:

• Your use of the Services
• Your content
• Your violation of these Terms
• Your violation of applicable law
• Your infringement of another person's rights

24. Changes to the Services

We may modify, suspend, discontinue, or introduce new features at any time. Where reasonably practicable, we will provide notice of significant changes that materially affect the use of the Services.

25. Changes to these Terms

We may update these Terms from time to time.

The revised version will be published within the app and, where applicable, on our website.

Your continued use of ParMitra after the revised Terms become effective constitutes acceptance of the updated Terms.

These Terms are governed by the laws applicable to the legal entity operating ParMitra, unless otherwise required by mandatory consumer protection laws in your country of residence.

Nothing in these Terms limits any rights that users may have under applicable consumer protection or privacy laws.
